1. Terms of Service

By accessing or using Selecta (the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service. We may update these Terms at any time; continued use after changes constitutes acceptance.

The Service lets creators upload images and videos and collect feedback from reviewers. You are solely responsible for the content you upload, for ensuring you have the rights to share it, and for complying with all applicable laws.

Acceptable use

  • No unlawful, infringing, defamatory, or harmful content.
  • No attempts to disrupt, reverse-engineer, or overload the Service.
  • No automated scraping, resale, or redistribution of Service features.

We may suspend or terminate accounts at our sole discretion, with or without notice, including for violations of these Terms.

2. Service Disclaimer — “As Is”

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED OPERATION.

We do not warrant that the Service will be error-free, secure, or continuously available, or that defects will be corrected. You use the Service at your own risk.

Content, storage, and data loss

You acknowledge and agree that:

  • You must keep your own backups. Selecta is a review and feedback tool, not a backup service or system of record. Always retain original copies of any images, videos, or files you upload.
  • Sessions, uploads, comments, votes, and other content may be deleted, lost, corrupted, altered, or made temporarily or permanently inaccessible at any time, including due to bugs, infrastructure failures, third-party outages, scheduled retention limits, plan downgrades, account termination, or human error.
  • Free-plan sessions and their content may expire and be permanently deleted after the retention period shown in your dashboard. We are not obligated to recover expired content.
  • We may modify, suspend, or discontinue any part of the Service — including features, storage limits, and integrations — at any time without liability.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SELECTA, ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Lost, deleted, corrupted, or inaccessible images, videos, comments, votes, or other content;
  • Lost profits, lost revenue, lost business opportunities, or lost clients;
  • Reputational harm, damage to brand, or impact on creative or commercial projects;
  • Costs of substitute services, re-shoots, re-edits, or re-uploads;
  • Service downtime, delays, missed deadlines, or any disruption to your business operations;
  • Unauthorized access to or alteration of your transmissions or content.

This applies whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SELECTA IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Selecta from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms.

4. Privacy

We store the data you provide (account details, uploaded media, comments, votes) to operate the Service. We do not sell your personal data. Reviewer names and emails are visible to the session owner who invited them.

You may request deletion of your account and associated data by contacting us. Some data may be retained as required by law or for legitimate operational records.

5. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-laws principles. Disputes shall be resolved in the competent courts of that jurisdiction.
